1. Introduction

These Terms of Use govern your access to and use of the Souq Al Shaikh website, products and related services.

The store is operated under the trade name Souq Al Sheikh. In these Terms, “Souq Al Shaikh,” “we,” “us” and “our” refer to the operator of the store. “You” and “customer” refer to the person accessing the website or placing an order.

Our website is powered by Shopify, which provides the e-commerce platform that enables us to offer our products to you. Purchases made through the store are made directly between you and Souq Al Shaikh—not Shopify.

By accessing the website or submitting an order, you agree to these Terms, our Privacy Policy, Shipping and Delivery Policy, and Returns and Refunds Policy.

Nothing in these Terms limits any mandatory rights available to you under applicable Saudi consumer law.

2. Eligibility

You must have the legal capacity to enter into a purchase agreement under applicable law. If you do not have legal capacity, you may use the store only with the involvement and consent of a parent or legal guardian.

You agree to provide accurate, current and complete information when submitting an order or creating an account.

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account. Contact us promptly if you believe your account has been accessed without authorization.

3. Product information

We make reasonable efforts to present product descriptions, specifications, prices and images accurately.

Product colours and appearance may vary slightly because of lighting, photography, manufacturing variations and device-screen settings. These minor differences do not affect your rights if a product is materially different from its description, damaged, defective or incorrect.

Product availability, specifications and descriptions may be updated. Changes will not materially alter an accepted order without notifying you and obtaining your agreement where required.

You must use products only for their intended purpose and follow any safety, installation, maintenance or usage instructions provided with them.

4. Orders and order acceptance

Submitting an order constitutes an offer to purchase the selected products.

An automated order acknowledgement does not necessarily mean that the order has been accepted. Cash on Delivery orders may be verified through telephone or WhatsApp before acceptance and dispatch.

An order is accepted when we confirm it through an available communication method or dispatch the order.

We may decline or cancel an order for legitimate reasons, including:

• Product unavailability.

• Incomplete or inaccurate customer information.

• An address outside our delivery area.

• An obvious pricing or description error.

• Failure to confirm a Cash on Delivery order.

• Reasonable suspicion of fraud, abuse or unlawful activity.

• Quantity or delivery restrictions disclosed before acceptance.

If an accepted prepaid order is cancelled by us, any amount collected for that order will be refunded without unreasonable delay.

Please review your products, quantities, telephone number and delivery address before submitting your order. Contact us promptly if you discover an error. We cannot guarantee that changes can be completed after dispatch.

Products purchased from the store are intended for personal or household use unless we agree otherwise.

5. Prices and payment

Prices are displayed in Saudi Riyals.

The total amount payable, including applicable taxes, delivery charges and other disclosed fees, will be shown before the order is submitted or communicated during order confirmation.

No undisclosed charge will be added to an accepted order. If a product is advertised with free delivery, no separate standard delivery charge will be collected.

Our current primary payment method is Cash on Delivery. The customer must pay the confirmed order total when the product is delivered.

Promotions and discount codes may have separate terms, including validity periods, eligible products and usage limits. Promotion terms will apply in addition to these Terms.

We will provide an order confirmation or invoice containing the required order and pricing information through an available electronic method.

6. Shipping and delivery

Delivery is available throughout the Kingdom of Saudi Arabia, subject to carrier coverage and any restrictions disclosed during order confirmation.

Most confirmed orders are estimated to arrive within 3–5 business days. Delivery times are estimates unless a specific delivery date has been expressly agreed.

We remain responsible for resolving confirmed loss, damage, incomplete delivery or incorrect delivery occurring before the order is delivered to you. Responsibility is not transferred to you merely because the parcel has been handed to a delivery company.

Delivery may be affected by remote locations, public holidays, severe weather, carrier disruptions or other circumstances outside our reasonable control. We will make reasonable efforts to communicate significant delays.

Your rights concerning delayed delivery, including any statutory right to cancel after an excessive delay, remain unaffected.

7. Returns, exchanges, refunds and cancellations

Eligible return requests may be submitted within 15 calendar days from delivery, subject to the conditions and lawful exclusions explained in our Returns and Refunds Policy.

For ordinary change-of-mind returns, the customer is responsible for the return-delivery cost unless we agree otherwise.

If a product arrives damaged, defective, incomplete or incorrect, we will cover the reasonable return or replacement delivery costs once the issue is confirmed.

Orders that have not been dispatched may be cancelled by contacting us promptly. If an order has already been dispatched, we may be unable to stop delivery, but you may request a return after receiving it in accordance with our Returns and Refunds Policy.

The 15-day change-of-mind period does not restrict separate rights relating to defective products, warranties, misleading descriptions or other rights available under applicable law.

8. Acceptable use

You may use the website only for lawful personal purposes.

You must not:

• Use the website for fraud, deception or unlawful activity.

• Submit false customer, payment or delivery information.

• Attempt to gain unauthorized access to the website, accounts or systems.

• Introduce viruses, malicious code or other harmful technology.

• Interfere with the website’s security or operation.

• Scrape or automatically collect website data without authorization.

• Copy or commercially exploit website content without permission.

• Infringe the intellectual-property, privacy or other legal rights of another person.

• Harass our employees, delivery representatives, customers or service providers.

We may restrict access where reasonably necessary to protect customers, the store or its systems. Restricting website access does not remove obligations relating to an already accepted order or any accrued consumer rights.

9. Intellectual property

Website content—including branding, logos, text, graphics, photographs, videos and layout—is owned by or licensed to Souq Al Shaikh and is protected by applicable intellectual-property laws.

You may view and use the website for personal, non-commercial shopping purposes. You may not reproduce, modify, distribute, publish, sell or commercially exploit protected content without the owner’s prior permission.

“Shopify” and related Shopify branding belong to Shopify or its licensors.

10. Shopify and third-party services

Shopify provides the technology used to operate the store but is not the seller of products purchased from Souq Al Shaikh.

We may use delivery companies, payment providers, analytics services and other service providers to operate the store and fulfil orders.

The website may contain links to independently operated third-party websites. We are not responsible for independent third-party content or transactions that do not involve products purchased directly from Souq Al Shaikh.

This section does not allow us to transfer responsibility for products sold by us to our suppliers, delivery providers or Shopify.

11. Customer reviews and feedback

If you submit a product review, photograph, suggestion or other feedback, you confirm that you have the right to submit it and that it is accurate and lawful.

You grant us a non-exclusive, royalty-free permission to display, reproduce and use that feedback for operating and promoting the store. We will not intentionally alter a review in a way that materially misrepresents your opinion.

We may remove content that is unlawful, fraudulent, abusive, misleading, offensive, irrelevant or infringes another person’s rights.

12. Privacy

Our collection and handling of personal information are governed by our Privacy Policy and applicable Saudi data-protection requirements.

Information necessary to process orders may be shared with Shopify, delivery companies, technology providers and other service providers involved in operating the store or fulfilling your order.

13. Errors and website availability

We may correct genuine typographical, technical, pricing or product-information errors.

If an error affects an order that you have already submitted, we will notify you and provide an appropriate option, which may include confirming the corrected information or cancelling the affected order without charge.

We do not guarantee that the website will always be uninterrupted or error-free. Temporary interruptions may occur because of maintenance, technical issues or circumstances outside our reasonable control.

14. Warranties and consumer rights

Any product-specific or manufacturer warranty will be described on the relevant product page or accompanying documentation where applicable.

Except where prohibited by law, we do not guarantee that the website will always meet every individual preference or expectation.

Nothing in these Terms excludes mandatory warranties, remedies or protections available for defective, unsafe, incorrectly described or non-conforming products.

15. Limitation of liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability arising from fraud, willful misconduct, gross negligence, violation of mandatory consumer rights, or defective products where liability is imposed by law.

To the extent permitted by law, we are not responsible for indirect or unforeseeable losses that do not result directly from our breach of these Terms.

We are not responsible for loss caused solely by the customer’s misuse of a product, failure to follow safety instructions, unauthorized modification or unlawful use.

16. Suspension and termination

We may suspend or terminate website access where a user materially violates these Terms, threatens website security, engages in fraud or uses the website unlawfully.

Termination of website access does not cancel an accepted order, eliminate a valid refund obligation or restrict rights that arose before termination.

17. Changes to these Terms

We may update these Terms to reflect legal, operational or service changes.

Material changes will be published on this page with a revised “Last updated” date and communicated where required by law.

Changes apply prospectively. The version in effect when an order is accepted will continue to govern that order unless a change is required by law or expressly agreed with the customer.

18. Severability and waiver

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be applied only to the extent legally permitted. The remaining provisions will continue to apply.

Failure to enforce a provision on one occasion does not permanently waive the right to enforce it later.

19. Governing law and disputes

These Terms and purchases made through the store are governed by the laws and regulations of the Kingdom of Saudi Arabia.

Please contact us first so that we can attempt to resolve any complaint promptly. Nothing in these Terms restricts your right to contact the Ministry of Commerce, another competent authority or a competent court in Saudi Arabia.
